RIGHT OF WAY PERMIT AND EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That (Id we), Karol J. & Lila Z. Kocimski (do/gees) hereby grant unto the
City of Ames, Iowa, a municipal corporation its successors and assigns, the
perpetual right to enter upon the land described and the perpetual right to
construct, reconstruct, clean up, operate, maintain, and cover over and repair
a water main upon, under, and across the land described as follows:
DESCRIPTION;
Centerline of a 10' permanent water main easement, and described as follows:
Commencing at the northeast corner of Lot 5, Westwood Village an official plat
in the City of Ames, Story County, Iowa; thence south 0000'00" west along the
east line of said Lot 5, 218.25'; thence north 90100100" west, 10.001 to a point
on the west line of an existing 10' water main easement said point also being
the point of beginning; thence continuing north 90000'00" west, 80.00' to a
point at which said easement terminates.
See attached plat marked and made a part hereof.
The foregoing rights are granted upon the express condition that the City of
Ames, Iowa, will assume all liability for all damages to the above described
property caused by the City's failure to use due care in its exercise of the
rights granted.
