Know all men by these presents, that the City of Ames, Iowa, a
Municipal Corporation organized and existing pursuant to the laws of the
State of Iowa, and the Grantor herein, in consideration of the sum of One
dollar ($1.00) and other ,valuable consideration to Grantors paid by Donald J.
Petersen and Pauline Petersen, the Grantees herein, receipt of which is hereby
acknowledged, does grant, release, and convey to Donald J. Petersen and
Pauline Petersen, their successors and assigns forever, a perpetual easement
over, under, and through the following described real estate for the purpose
of constructing, using, replacing, and maintaining a water service line from
Grantees premises abutting on State Avenue, across Railway Park, to the water
main located on Oakwood Road, including the right to clean, repair, replace
and care for such water service line, together with the right of access to said
easement for said purposes:
DESCRIPTION OF EASEMENT: Commencing at the Southwest Corner
of Section 16, Township 83 North, Range 24 West of the 5th P.M. ,
Story County, Iowa, thence North 1065.4' feet along the West
line of said Section 16 to the intersection of State Ave. and
Oakwood Road; thence North 850 37' 20" East, 113' feet; along
the traveled centerline of Oakwood road; thence North, 26' feet
to the point of beginning; a ten foot wide easement centered on
the following described line; thence South 530 West, 16' feet;
thence West, 30' Feet- thence North 370 05' 20" West, 25.1'
feet; thence North 246 54' 40" East to the Southeast line of
Lot 12 of Christensen's Subdivision.
This Deed of Easement is executed and delivered and said easement is
granted upon the following conditions, to wit:
1. The Grantees, their agents, heirs, employees, successors and
assigns shall, as soon as possible after construction of said water service line
and any and all subsequent repairs or alterations thereunto, restore all prop-
erty of the grantor to a neat and presentable condition with all sod removed
either restored or replaced as directed by Grantors Department of Parks and
Recreation.
2. The rights granted herein shall not be construed to interfere
with or restrict the Grantor with respect to the construction and maintenance
of property improvements along and over the premises herein described so long

as the same are so constructed as not to impair the strength or interfere
with the use and maintenance of the said water service line.
3. This covenant is to run with the land.
IN WITNESS WHEREOF, the parties hereto have caused this instru-
ment to be signed and sealed by their authorized representatives as of the
dates indicated.
