Speck, husband and wife, in consideration of the sum of One Dollar and other valuable consideration, the receipt of which is hereby acknowledged, does hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the right to enter 'upon the land described and the perpetual right to construct, reconstruct, clean up, operate, maintain, cover and repair water mains upon under and across the land described as follows: 5 feet on each side of a line described as beginning at a point on the South line of Section 26, Township 84 North, Range 24 West of the 5th P. M. and 883. 5 feet East of the Southwest corner of said Section 26, thence North 970 feet, more or less, to a point on the South line of Over- �- - land Heights, a subdivision of a part of the Southwest Quarter of said Section 26 and 12 feet west of the South- west corner of Lot 32 of said Overland Heights. TItere is also hereby granted a temporary right of encroachment over and across adjacent land on each side of the above described line for construction purposes. The foregoing rights are hereby granted upon the express condition that the City of Ames, Iowa will assume liability for all damages to the above described property caused by the city's failure to use due care in its exercise of the rights granted.
