HORN$ACHER, Recorder 4. ....................................Deputy WHEREAS, proceedings have been or are about to be taken by the City of Ames for the grading of South 16th Street from South Duff Street west to the Chicago and Northwestern Railway tracks and it is essential to such street improvement that said City require perpetual easements for the pur- pose of construction of slopes within the lines of certain privately owned real estate abutting the said improvement and to go on to said real estate in such manner and at such times as shall be convenient to the maintenance or further improvement of South 16th Street; and WHEREAS, Grand Center, Inc., an Iowa corporation, now owner by means of a merger by Rolling Homes, Inc. of real estate as is hereinafter described and desires that such slopes be constructed upon the real estate owned by Grand Center, Inc. said land being legally described as: Commencing at the Northeast Corner of the NW 1/4 NE 1/4 Sec. 15-T83N-R24W and running thence South 35 feet to the point of beginning; thence continuing South a distance of 15 feet; thence West 50 feet distant from and parallel to the North line of said Section 15 a distance of 50 feet; thence North 10 feet; thence West 40 feet distant from and parallel to said North line of Section 15 a distance of 200 feet to a point perpendicular to Centerline Station 222+24.42 of South 16th Street, thence along a 676.62 foot radius curve concave to the right until it intersects the North line of said Section 15, thence East along said North line of Section 15 to the South right-of-way line of South 16th Street, said right-of-way line being 35 feet distant from centerline, thence Easterly along the South line of South 16th Street to the point of beginning; all located in the City of Ames, Story County, Iowa, and containing 0.066 acres, more or less. Therefore, in consideration of the premises and of the sum of one dollar ($1.00) paid to Grand Center, Inc. by the City of Ames, receipt of which is hereby acknowledged, Grand Center, Inc., owner of the here- inabove described real estate have granted and conveyed and do hereby grant and convey unto said City of Ames, a municipal corporation in the County of Story, State of Iowa, a perpetual easement in and upon said real estate to the extent necessary in the determination of the Director of Public Works of said City for the purpose of constructing such slopes in and upon said premises as said Director of Public Works shall determine are required for and in connection with the hereinabove public improvement to wit: the grading of South 16th Street west from Duff Avenue to the Chicago and Northwestern Railway tracks and the right and authority to go on to said real estate in such manner and at such times as shall be convenient to the maintenance or further improvement of South 16th Street and to make all excavations, embankments, cuts and fills requisite to the construction of said slopes in and upon said premises and Grand Center, Inc. does hereby further forever release said City of Ames from all claims or demands which Grand Center, Inc. may have or hereafter acquire against said City by reason or on account of any injury sustained to said real estate or improvement thereon of any nature whatsoever on account of the construction of said slopes.
