One Dollar and other good and valuable consideration, the receipt of whicl-I
is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, a
municipal corporation, its successors and ass ignsi.-,the-:perpetual right L1
enter upon the land described and the perpetual right to construct, iecon-
struct, clean up, operate, maintain, and cover over and repair a retaining
Nvall upon, under and across the land described as follows:
Beginning at a point in the TEast line of Lot 3, Greer's Sub-
division of Lot 24, Parker's Addition to the City of Ames,
Iowa, at a point 17 feet South of its Northeast corner, thence
North 5 feet, thence West 42 feet distant from and parallel
to the North line of said, Lot 3 and the North line of said
Lot 3 extended to the VVest line of Lot 5, Farker's Addition,
thence South to the North line of Chamberlain Street, thence
Northeasterly and East along the North line of Chamberlain
Street to the point of beginning.
There is also hereby granted a right of ingress and egress over and
across adjacent land and a temporary right of encroachment over and
across adjacent land on either side (if the above described line only during
the period of construction.
The foregoing rights are granted upon the express condition that the
City of Ames, Iowa, 'will assunne all liability for all damages to the above
described property caused by the City's failure to use due care in its ex-
ercise of the rights granted.
