RIGHT-OF-WAY PERMIT AND EASEMENT
Erben A. Hunziker and Margaret H. Hunziker, husband and wife,
and Donald M. Furman and Ruth W. Furman, husband and wife, ;.n cr,n_
sideration of the sum of One Dollar and other good and valuable consider-
ation, the receipt of which is hereby acknowledged, do hereby grant unto
the City of Ames, Iowa, a municipal corporation, its successors and
assigns, the perpetual: right to enter upon the land described and the per-
petual right to construct, reconstruct, clean up, operate, maintain and
cover over and repair a storm sewer upon, under and across the land
described as follows:
The West 10 feet of the East 103. 4 feet of Lot 1, North
Park Subdivision to the City of Ames, Iowa.
Also, the West 10 feet of the East 103. 4 feet of Lot 2,
North Park Subdivision to the City of Ames, Iowa.
There is also hereby granted a right of ingress and egress over
and across adjacent land and a temporary right of encroachment over
and across adjacent land on either side of the above described line only
during the period of construction.
The foregoing rights are granted upon the express condition that
the City of Ames, Iowa, will assume all liability for all damages to the
above described properties caused by the City's failure to use due care
in its exercise of the rights granted.
