RIGHT OF WAY PERMIT AND EASEMENT
Edgar V. Collins, Jr. and Dorothy J. Collins, husband and wife,
in consideration of the sum of One Dollar and other good and valuable consider-
ations, the receipt of which is hereby acknowledged, do hereby grant unto the
City of Ames, Iowa, a municipal corporation, its successors and assigns, the
right to enter upon the land described and the perpetual right to construct,
reconstruct, clean up, operate, maintain, cover over and repair a storm
sewer upon, under and across the land described as follows:
5 feet on each side of a line described as lying 16
feet North of and parallel to the South line of
Outlot 'A", Oak Park Addition to the City of Ames,
Iowa, and lying West of the alley between Brookridge
Avenue and Ridgewood Avenue.
The foregoing rights are granted upon the express conditions that
the original construction of this storm sewer shall be by jacking underground
and no open excavation shall be made; that all repair of said storm sewer shall
be done from inside, if possible, and no open cut repair will be done; that if
impossible to repair from the inside, such repair shall be by augering or
drilling or controlled excavation of a size not to exceed 10 feet by 10 feet
at the surface; that the City of Ames will assume all liability for all damages
to the grantor's property caused by said City's failure to use due care in its
exercise of the rights granted;that the City of Ames, Iowa will assume
liability for all damages at any time caused by said storm sewer, its repair
their heirs and assigns
or maintenance, to the buildings or the contents thereof belonging to grantors/
lying south of the storm sewer line, and in event the residence is at any time
uninhabitable from such cause the City will pay the cost of housing acco#bxdAtWhAaZ
elsewhere for grantors and family, until such residence is habitable, and,
that the City will, replace in like condition any and all areas disturbed or
damaged in repair or maintenance operations, now existing or hereinafter
placed on grantor's property, and in event the same cannot be replaced or
trees die or are removed as a result of said storm sewer, its repair or
maintenance, that the value thereof shall be determined by arbitration and
