HomeMy WebLinkAboutA001 - Council Action Form dated October 25, 1994 RN r Item # / Date: October 25. 1994 COUNCIL ACTION FORM SUBJECT: PARTIALLY VACATING A STORM SEWER EASEMENT OVER OUTLOT A, OAK PARK ADDITION (836 BROOKRIDGE AVENUE). BACKGROUND: The property owner of 836 Brookridge Avenue is planning to construct an addition to his house. This addition would encroach 2' into a 10' wide storm sewer easement described as 5' on each side of a line lying 16' north and parallel to the south line of Outlet A, Oak Park Addition to the City of Ames, Iowa and lying west of the alley between Brookridge Avenue and Ridgewood Avenue. It is City policy to not allow the construction of permanent buildings such as houses to encroach into easements. Staff has determined that 2' of the easement could be vacated and there still would be enough easement left for the storm sewer. The existing storm sewer is forty feet deep in this area. In order to make repairs on the storm sewer using open cut methods would require more width than the easement. It would be less expensive to make repairs of the pipe from inside the pipe or the pipe would be rerouted. This is because it would be necessary to purchase and demolish the house. ALTERNATIVES: 1. Approve the request and allow the home owner to build his new addition two feet into the existing easement. 2. Deny the request. In either alternative, in order for the City to use open cut methods to repair the storm sewer next to the house, it would require demolition of the house. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve vacating the south 2' of the storm sewer easement described as 5' on each side of a line lying 16' north and parallel to the south line of Outlet A, Oak Park Addition to the City of Ames, Iowa in order to allow construction of the addition to 836 Brookridge Avenue.
