RIGHT OF WAY PERMIT AND BASEMENT
Herbert R. Hatch and Miriam O. Hatch, husband and wife, in
consideration of the sum of One Dollar and other valuable considerations,
the receipt of which is hereby acknowledged, do hereby grant unto the City
of Ames, Iowa, a municipal corporation, its successors and assigns, the right
to enter upon the land described, and the perpetual right to construct,
reconstruct, clean up, operate, maintain, cover over and repair a storm
sewer upon, under and across the land described as follows:
5 feet on each side of a line described as lying 16 feet
North of and parallel to the South line of Outlot "A",
Oak Park Addition to the City of Ames, Iowa, and
lying East of the alley between Brookridge Avenue and
Ridgewood Avenue.
The foregoing rights are granted upon the express condition that the
City of Ames, Iowa„ will assume liability for all damages to the above
described property caused by said City's failure to use due care in its
exercise of the rights granted; that the City of Ames will replace the above
described real estate after construction in the same condition as it presently
exists, including the replacing of the crushed rock surface and black dirt in
the garden area; that the City of Ames, Iowa will assume liability for all
damages at any time caused by said storm sewer, its repair or maintenance,
to the buildings or the contents thereof belonging to grantors, their successors
or assigns, lying North of the storm sewer line extended westerly; and, that
the City will replace in like condition any and all areas disturbed or damaged
in repair or maintenance operations, now existing or hereinafter placed on
grantor's property.
