i s RIGHT-OF-WAY AMID EASEMENT FCR LINCOLN WAY RELIEF SANITARY SEVER The Iowa State Board of Education for and in consideration of the con- ditions as herein contained, does hereby grant to the City of Ames, Iowa, the perpetual right to construct, reconstruct, operate, maintain and repair a sanitary sewer in the location as described herein and shown on the plat attached hereto and made a part hereof, upon and across the property of the State of Iowa known as Iowa State College, located in the Southeast one- quarter (SE+) of the Southeast one-quarter (SE+) of Section 4, Township 83 N, Range 24 West of the 5th P. M. The foregoing right is granted upon the following express conditions, to-wit: (1) That, the sanitary sewer shall be constructed in the following described location: Beginning at a point 22 feet North of the center of Lincoln Way in line with the West line of Beech Avenue; thence North 00 261 East 632.3 feet; thence North 890 461 West 471 feet; thence_MorUL Q.° 24-1 W-141.1-. feet; thence South 82e"-01-r bleat 227;Y Y`eet; thence South 510 131 West 152.5 feet; thence South 38© 241 West 143 feet; thence South 560 34r West 416 feet; thence South 10 421 East 319 feet; thence South 420 501 West 55.5 feet to a point in Lincoln Way 18 feet North of the center line at the intersection of . Ash Avenue. (2) That, the City of Ames, will assume liability for all damage to the property of the State of Iowa known as Iowa State College caused by said City's failure to use due care in its 'exercise of the granted right. (3) That, the City of Ames, Iowa, will permit Iowa State College to connect any or all of its dormitories to any part of the sanitary sewer system of the City for the purpose of the disposal of sanitary wastes from said dormitories and will, upon the execution of this easement, place to the credit of Iowa State College the sum of Two Thousand Dollars ($2,000.00), which amount said Iowa State College may use solely for the purpose of defraying the costs of the City of Ames for the disposal of such sanitary sewage at the agreed rate or charge of fifty cents (500) per capita per year for each occupant of the dormitories so connected. {4) That, upon the completion of the construction of the Lincoln Way Relief Sanitary Sewer the City will abandon the use of the existing sanitary sewer now located on the property of the State of Iowa known as Iowa State College, between Ash Avenue and Beech Avenue which:'_ existing sanitary sewer shall' become available for use by Iowa State College.
