HomeMy WebLinkAbout~Master - Sanitary Sewer - Olsan qr i RIGHT OF WAY PERMIT AND EASEMENT We, Charles Olean and Margaret Olean, husband and wife, in con- sideration of the sum of One Dollar and other valuable consideration, the receipt whereof is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the right to enter upon the land described as: Lots 1 and 2 lying West of Hyland Avenue and Lots 6 and 7 all in the West Half of the NWl/4 of Section 4, Township 83 North, Range 24 West of the 5th P. M. , Iowa, and the perpetual right to construct, reconstruct, clean up, operate, maintain, cover over and repair a sanitary sewer on said land, said sewer being located on the land above described in approximately the following line: Beginning at a point on the West line of Lot 7 in W1/2 NE FR1/4 Sec. 4-83-24, 49. 0' North of El/4 Car. Sec. 5-83-24, thence S 450 04' 573 it. , thence N 810 02' E. 296 ft. , thence N 270 58' E to west line Hyland Avenue. The foregoing right is granted upon the express condition that the City of Ames, Iowa, will assume liability for all damage to the above des- cribed property caused by said City's failure to use due care in its exercise of the granted right. Notary Public tory County, Iowa i MEMORANDUM AND AGREEMENT In consideration of Charles Olean and Margaret Olsan, husband and wife, granting unto the City of Ames, Iowa, an easement in connection with a sanitary sewer across the land described as: Lots 1, 2, 6 and 7 in the West Half of the Wk of Section 4, Township 83 North, Range 24 West of the 5th P. M. , Iowa, the City of Ames does hereby agree to allow the said Charles Olean and Margaret Olsan, their successors and assigns, to make one connection to said sewer line on the property aforesaid, for one single residence only, without cost, subject, however, to said connection being made in accordance with the lams, regulations, and ordinances of the City of Ames, Iowa.
