Eide and Irene Eide , their heirs do hereby grant and convey to City of Ames successors & assigns a permanent easement and right-of-way in which to construct, reconstruct, operate, remove, repair, and maintain underground pipelines and mains for the conveyance of sewage and control cable in, over, across, through, and under the following described real property: Description A permanent easement 30' in width centered on a line more particularly described as follows: Beginning at a point 761.33' W. of the N% cor. Section 31 T83N R23W and running thence South 360 45' 25" E. 1,123.58' to a point 900.4' S. and 84.21' W. of said N% cor. thence N. 880 09' 00" east to the west R.O.W. line of I-35. Also a temporary construction easement 55' in width on the east and 15' in width on the west parallel to and abutting above described permanent ease- ment. All located in Sec. 31 T83N R23W of the 5th P.M. and containing 0.77 and , 1 .81 acres respectively. Reserving, however, in and to O.B. Eide and Irene Eide , the right at all times to enter upon and occupy the said real property or any part thereof and make any proper use thereof so long as said occupancy and use do not infringe upon, hinder, or limit the right herein granted to said City to construct, reconstruct, operate, remove, repair, and maintain the said underground pipelines and mains. ti The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume all liability for all damages to the above de- scribed property caused by the City's failure to use due care in its exer- cise of the rights granted.
