Know all persons by these presents that George A.Risley & Jerry F. Shinn, their heirs ,
do hereby grant and convey to City o Ames successors &
a permanent easement and right-of-way in which to construct, reconstruct, assigns
operate, remove, repair, and maintain underground pipelines and mains for
the conveyance of sewage and control cable in, over, across, through, and
under the following described real property:
Description
A permanent easement 30 ' in width centered on a line more particularly described as
follows:
Beginning at a point 1,569.74' east of the northwest corner Section 24 T83N R24W and
running thence south 210 36' 26' E. 5,633.21' , thence south 160 21' 35" east 26.3' to
a point 983' east of the South 4 corner of said Section 24 T83N R24W. Also a
temporary construction easement 15' in width on the east and 55' in width on the west
parallel to and abutting above described permanent easement. All located in Section
24 T83N R24W of the 5th p.m. and containing 3.87 and 9.04 acres respectively.

q Reserving, however, in and to George A. R isl ey& Jerry F. Shinn , the
right at all times to enter upon and occupy the said real property or any
part thereof and make any proper use thereof so long as said occupancy and
use do not infringe upon, hinder, or limit the right herein granted to said
City to construct, reconstruct, operate, remove, repair, and maintain the
said underground pipelines and mains.
The foregoing rights are granted upon the express condition that the City
of Ames, Iowa, will assume all liability for all damages to the above de-
scribed property caused by the City's failure to use due care in its exer-

EASEMENT COMPENSATION
1. Easement compensation for 5,659.51 feet across the property at $2.40
per lineal foot of trench excavated for pipe installation totals
$13,582.84.
2. For 12.91 acres of agricultural land disturbed by the construction,
the City will pay $130.00 per acre for each of the first two years,
$65.00 per acre for the third year, and $32.50 per acre for each of
the fourth and fifth year for a total of $5,034.91.
3. Excess excavated material will be placed to control runoff just east
of the paving on Ken Maril Road and at other points designated to
control erosion.
4. The top 2 feet of topsoil will be stripped, stockpiled, and respread
over the disturbed area.
5. Fences shall be restored to a condition equal to or better than
existed prior to construction.
6. Rocks larger than 3" in diameter shall be removed from the easement
area.
7. Use of temporary construction easements will continue for a period not
to exceed one year from the start of construction on the property.
8. Tiles or other pipelines will be re-established or rerouted.
9. No manholes or structures will be exposed in land used for tillable
agricultural purposes.
10. Payment will be made upon acceptance by the City of Ames City Council
and the easement will be effective upon payment of the above compensa-
tion.

ADDITIONAL CLAUSE
11 . The overburden above the top of the pipe at Sta. 99+00 shall be a
minimum of 6.2' in depth.
12. Tenant shall be compensated for crop loss on the basis of $200 per acre
per year for 2 years for a total of $5,164.
