Know all persons by these presents that David Norris & Carlene H. Norris , their heirs ,
do hereby grant and convey to City of Ames successors &
a permanent easement and right-of-way in which to construct, reconstruct, assigns
operate, remove, repair, and maintain underground pipelines and mains for
the conveyance of sewage and control cable in, over, across, through, and
under the following described real property:

Reserving, however, in and to David Norris & Carlene H. Norris the
right at all times to enter upon and occupy the said real property or any
part thereof and make any proper use thereof so long as said occupancy and
use do not infringe upon, hinder, or limit the right herein granted to said
City to construct, reconstruct, operate, remove, repair, and maintain the
said underground pipelines and mains.
The foregoing rights are granted upon the express condition that the City
Of Ames, Iowa, will assume all liability for all damages to the above de-
scribed property caused by the City's failure to use due care in its exer-
cise of the rights granted.

A permanent easement 30' in width centered on a line more particularly described as
follows:
Beginning at a point 982.96' east of the A corner of Section 25-T83N-R24W and
running thence South 160-21'-35" East, 1,384.05' , thence South 430-43'-24" East
18.31' .
Also a temporary construction easement more particularly described as follows:
Beginning at a point 997.96' east of the A corner said Section 25 and running thence
east 15' thence southeast of and parallel to above described permanent easement a
distance of 884' , thence east to the centerline of the Skunk River, thence south
along said centerline of the Skunk River to the south line of the N� NE% said Section
25, thence west to the east line of above described permanent easement, thence north
parallel to the east line of said permanent easement to the point of beginning.
Also a temporary construction easement further described as follows:
Beginning at a point 967.96' east of the N% corner Section 25-T83N-R24W and running
thence southwest of and parallel to above described permanent easement to the south
line of the N� NE4 said Section 25, thence west along said south line N1 NE4 to a
point 85' west of the west line of said permanent easement, thence north 85' distant
from and parallel to said west line of permanent easement 350' , thence east 301 ,
thence north parallel to above described permanent easement to the north line of
Section 25-T83N-R24W, thence east 55' to the point of beginning. All located in
Section 25-T83N-R24W of the 5th P.M. and containing 1.03 acres of permanent easement

EASEMENT COMPENSATION
1. $2.40 per lineal foot of pipe installed across the property for a
total cost of $3,365.64
2. Crop loss for the next five years based on $130 per acre. Crop loss
will be full payment for the first two years, one-half for the third
year and one-fourth for the fourth and fifth years for a total of
$1,875.90.
3. Excess excavated material will be placed to control runoff at points
designated to control erosion. These areas include the north and west
ends of the property in particular.
4. The top 2 feet of topsoil will be stripped, stockpiled, and respread
over the disturbed area.
5. Fences shall be restored to a condition equal to or better than
existed prior to construction.
6. Rocks larger than 3" in diameter shall be removed from the easement
area.
7. Use of temporary construction easements will continue for a period not
to exceed one year from the start of construction on the property.
8. Tiles or other pipelines will be re-established or rerouted.
9. No manholes or structures will be exposed in land used for tillable
agricultural purposes.
10. Payment will be made upon acceptance by the City of Ames City Council
and the easement will be effective upon payment of the above compensa-
tion.
11. A future connection to the sewer will be allowed if all city, county,
state, and federal regulations and policies would allow such a con-
nection. All appropriate fees will be paid by the owner if a connec-
tion is made.

12. Tenant shall be compensated for crop loss on the basis of $200.00 per acre
per year for two years for a total of $1,924.00.
