RIGHT OF WAY PERMIT AND EASEMENT
Know all persons by these presents that United Bank & Trust, Trustee of the
Ronald Jordan Family Trust, Grantor, its heirs, successors, and assigns, do
hereby grant and convey to City of Ames, Grantee, a permanent easement and
right—of—way in which to construct, reconstruct, operate, remove, repair,
and maintain one underground sanitary sewer line consisting of pipe, man—
holes, and protective structures for conveyance of sewage and one control
cable system in and under the following described real property:
Description
A permanent easement more particularly described as follows:
Beginning at a point on the east line of Section 25 T83N R24W 112.54' north
of the SE Corner NEk thereof and running thence north 45.51 , thence west
431 , thence south 430 44' 42" east 62.6' to the point of beginning. All
located in Section 25 T83N R24W of the 5th P.M. and containing 0.02 acres
more or less.
Reserving, however, in and to said Grantor, the right at all times to enter
upon and occupy the said real property or any part thereof and make any
proper use thereof so long as said occupancy and use do not infringe upon,
hinder, or limit the right herein granted to said City to construct,
reconstruct, operate, remove, repair, and maintain the said underground
sewer line and control cable.
The foregoing rights are granted upon the express condition that the City
of Ames, Iowa, will assume all liability for all damages to the above de—
scribed property caused by the City's failure to use due care in its exer—
cise of the rights granted, including any damage to crops, pasture, trees,
or fences.

respectively, of said corporation; (the seal affixed hereto is the seal of the
said corporation). That said instrument was signed on behalf of said corpora-
