SURFACE DRAINAGE EASEMENT Fu s Q•Qb
We, Marion C. Haynes and Doris K. Haynes, husband and
wife; R. Friedrich and Sons, Inc. ; Alden Harrison and Olive
Harrison, husband and wife; and Charles Sondrol and Jean Sondrol,
husband and wife; in consideration of the sum of One Dollar,
receipt of which is hereby acknowledged, do hereby grant to the
City of Ames, Iowa, a municipal corporation, its successors and
assigns, the perpetual right to maintain surface storm sewer
drainage, over and across the following-described real estate:
Five (5) feet on each side of the
following-described centerline:
"The West line of the SW 1/4 of the
SW 1/4 of Section 1 - T83N - R24W
of the 5th P.M. , in the City of Ames,
Story County, Iowa (said line also
being the East line of the SE 1/4
04894 of the SE 1/4 of Section 2) , and

&&Y COUNTY, IOWA of-Way line of the C & NW Railroad, "
FILED FOR RECORD

at the intersection of the west line
of the SW 1/4 of the SW 1/4 of
Section 1 - T83N - R24W of the 5th
P.M. , in the City of Ames, Story

with and 150 feet southeasterly from
the centerline of the main track of
the Chicago and North Western Railway
Company (previously known as the
Cedar Rapids and Missouri River
Railroad Company) ; thence N 83° 22 '
40" E, 28. 0 feet along a line parallel
with and 150 feet southeasterly of
said centerline of the main track of
the C & NW Railway Co. ; thence S 230
05' 25" W, 70. 9 feet; thence North,

The foregoing right is granted and accepted by the
City of Ames, Iowa, with the understanding that the City of Ames
shall have no obligation to maintain and repair the drainage
ditch and with the understanding that the surface water now
drains in a northerly direction and discharges on land owned
by the City of Ames. Any maintenance and repair of the drainage
ditch shall be shared one-third by Marion C. Haynes, one-third
by R. Friedrich and Sons, Inc. , and one-third by Alden Harrison
and Charles Sondrol, or their heirs and assigns, until such
time as the drainage ditch becomes a part of the storm sewer
system of the City of Ames./
