(do/does) hereby grant unto the City of Ames , Iowa, a municipal
corporation, its successors and assigns, the perpetual right to
enter upon the land described and the perpetual right to construct ,
reconstruct, clean up, operate , maintain, and cover over and repair
a storm sewer upon, under and across the land
described as follows :
DESCRIPTION
A permanent easement ten (10) feet in width and a temporary easement forty-
five (45) feet in width centered on a line more particularly described as
follows: Beginning at a point on the West line of the East Thirty (30) Feet
of Lot 4 and One Hundred Twenty (120) Feet South of the South Right-of-way line
of West Street, thence North 690 40' East Two Hundred Four (204) Feet; thence
North 80 28' East Forty-one (41) Feet to the South Right-of-way line of West
Street and containing 0.08 and 0. 17 acres respectively, all being in Brown's
Subdivision, Ames, Iowa.
See attached plat marked and made a part hereof.
The foregoing rights are granted upon the express condition that
the City of Ames , Iowa, will assume all liability for all damages to
the above described property caused by the City' s failure to use due
care in its exercise of the rights granted.

EASEMENT COMPENSATION EXHIBIT
1. The City of Ames will pay $700.00 to the owner for the easement and
relocation of the flower bed.
2. Following construction, the area will be landscaped to match neighboring
properties and a minimum of 22feet of fill will be added to the swale
area.
3. All disturbed areas will be sodded after fill has been placed. The City
of Ames will reimburse the property owner for water to establish the sod.
4. The sidewalk along West Street abutting the east 90 feet of Lot 1 shall be
removed and replaced to facilitate drainage to the street.
5. The existing house storm sewer drain shall be connected to the new storm
sewer.
6. One cherry tree and one plum tree shall be removed. City to compensate the
owner in the amount of $60.00 to purchase replacement trees.
7. The City shall insulate the sanitary sewer service in West Street by placing
4" of styrofoam insulation over the pipe.
