(do/does) hereby grant unto the City of Ames , Iowa, a municipal
corporation, its successors and assigns , the perpetual right to
enter upon the land described and the perpetual er etual right to construct,
reconstruct, clean up, operate, maintain, and cover over and repair
a storm sewer upon, under and across the land
described as follows :
DESCRIPTION
A permanent Easement Fifteen (15) Feet in width and a temporary Easement Forty-
five (45) Feet in width centered on a line more particularly described as
follows: Beginning at a point on the West line of Lot 5 and One Hundred Fifty-
two (152) Feet South of the Northwest Corner of said Lot, thence N 760 21' East
Thirty-five (35) feet, thence North 690 40' East Sixty (60) Feet to a point on
the East line of the West Thirty (30) Feet of Lot 4 and One Hundred Twenty (120)
Feet South of the South Right-of-Way line of West Street and containing 0.03
and 0.07 acres respectively, -all being in Brown's Subdivision, Ames, Iowa.
See attached plat marked and made a part hereof.
The foregoing rights are granted upon the express condition that
the City of Ames , Iowa, will assume all liability for all damages to
the above described property caused by the City' s failure to use due
care in its exercise of the rights granted.

EASEMENT COMPENSATION EXHIBIT
1. The City of Ames shall compensate the owners $700.00 for the easement
and for being unpble to utilize their garden.
2. Following construction, the disturbed area shall be graded and landscaped
to match neighboring properties. .
3. All grassed areas disturbed by the construction shall be sodded. The
City of Ames will reimburse the property owner for water used to establish
the sod.
4. The City will transplant one existing plum tree on the east side of the
property to a site designated by the owner and remove 3 other plum trees
within the construction area.
5. The construction limits shall be fenced with snow fence or equivalent.
6: The drainage channel from the south shall be reshaped to flow directly
to the beehive intake.
