See attached plat marked and made a part hereof. The foregoing rights are granted upon the express condition that the City of Ames , Iowa, will assume all liability for all damages to the above described property caused by the City' s failure to use due care in its exercise of the rights granted. The City of Ames shall compensate the owners $700.00 for the easement and for being unpble to utilize their garden. 2. Following construction, the disturbed area shall be graded and landscaped to match neighboring properties. . 3. All grassed areas disturbed by the construction shall be sodded. The City of Ames will reimburse the property owner for water used to establish the sod. 4. The City will transplant one existing plum tree on the east side of the property to a site designated by the owner and remove 3 other plum trees within the construction area. 5.
