HomeMy WebLinkAbout~Master - Storm Sewer - USDA Science & Education Administration • iI" fair►• UNITED STATES DEPARTMENT OF AGRICULTURE --Q Science & Education Administration FEE QO EASEMENT DEED THE UNITED STATES OF AMERICA,acting by and through the Regional Administrator, North Central ,*gi on, 11_ S_ Dapartment of Agriculture.,ture., Science & Education Administration, AR, first party(hereinafter called United States),hereby grants and conveys an easement to City of Ames, Ames, T nygn, second party (hereinafter called Grantee) to construct,maintain and use a storm sewer (hereinafter referred to as facilities, in,on,across,over or under,as may be,of the property of the United States,as hereinafter describ- ed,and as shown on plans numbered Exhibit A, which are attached hereto and made a part hereof:(insert easement description): A 10 foot permanent easement (bounded on the west by a 10 foot temporary construction easement) bounded on the East by a line more particularly described as follows: Beginning at the North edge of the aoxeslapproximately 15 feet North of the SW corner of Lot 4, Harrison Subdivision, City of Ames; Story County, Iowa; then North 105 feet more or less to the Lot line. The foregoing easement is given pursuant to the Act of October 23, 1962 (76 Stat 1129) the delegation of authority by the Secretary of Agriculture to the Assistant Secretary for Conservation, Research and Education,and the dele- gation of authority from the Assistant Secretary for Conservation, Research and Education to the.Director, Science & Education Administration, effective January 24, 1978, the provisions of which have been duly complied with,and is made subject to the following terms and conditions: 1. The Administrative Officer is designated as the onsite representative of the Sci ence Education Administration, National Animal Disease Center Ames, Iowa, for the administration of this easement. 2. The United States does not warrant the title to any of said land,and the rights and privileges herein granted shall be subject to any mineral reservation or other rights, if any,now outstanding in third parties. 3. The rights and privileges hereby granted shall not be assigned by the Grantee without the written consent of the United States. 4. The Grantee shall be liable for any damage resulting to the United States from the use of the property by the Grantee and shall hold the United States harmless from any and all claims or damages by third parties from the use of the property by Grantee. 5. The United States reserves unto itself, its nominees and assigns,the right to use any part of said lands for any purpose,provided such use does not interfere with the rights and privileges hereby granted. 6. The Grantee shall be responsible for the maintenance and security of all of its equipment located within the easement area covered by this grant. 7. No soil or materials shall be placed on property of the United States outside of the,granted area,and refuse,if any,resulting from clearing of the land shall be disposed of to the satisfaction of the onsite representative or designee. 8. Any property of the United States damaged in connection with said construction will be repaired by the Grantee at no expense U to the United States. 9. The Grantee shall not use an "active ingredient"as defined in Section 2 of the Federal Insecticide,Fungicide,and Rodenticide Act,as amended (61 Stat. 163;7 U.S.C.§ 135 et seq.), in violation of said Act on the land described in this easement. 10. The area granted shall be subject to the express covenant that it will be modified,adapted,or discontinued if found by the Regional Administrator,.SEA,or his designated representative,to be necessary,without liability or expense to the United States,so as not to conflict with the use and occupancy of the land for any authorized works which may be hereafter constructed thereon under the authority of the United States. 11. In the event the Grantee fails to use the easement for a consecutive 2 year period from the date hereof,or in the event the Graniee shall at any time abandon the use of the property for the purpose for which granted,or in the event the Grantee shall violate any of the provisions of this grant,the United States may terminate this grant by giving the Grantee notice in writing 60 days in advance of such termination and the rights thereby granted shall thereupon terminate. 12. Upon the revocation or termination of this grant,the Grantee may,within a period of 120 days of the effective date of termination,remove all structures which have been placed on the premises by the Grantee,but upon failure to remove the structures they shall become property of the United States. 13. The Grantee does by the acceptance of this easement covenant and agree for itself, its assigns,and its successors in interest to the property herein conveyed or any part thereof,that the covenants set forth below shall attach to and run with the land: (a) That the aforesaid granted easement area will be used in full compliance with Title VI of the Civil Rights Act of 1964, and all requirements imposed by or pursuant to the regulations issued thereunder by the Department of Agriculture and in effect on the date of this deed to the end that no person in the United States shall,on the ground of race,color,religion, sex,age,or national origin,be excluded from participation in,be denied the benefits of,or be subject to discrimination under any programs or activities provided thereon;and INST.NO.
