HomeMy WebLinkAbout~Master - Parking - Harms J O'7258 .Y PARKING EASEMENT FEE$ The undersigned Grantors being the owners of the lands hereinafter described do hereby grant and convey to the City of .Ames and to the present and future occupants of a building located at 2408 Chamberlain Street,• Ames, Iowa, and legally described on Exhibit "A" , attached hereto and made a part hereof, an easement to park or direct and permit the parking of the personal auto- mobiles of the occupants of the aforesaid building and their invitees on the following-described real estate located at the Northwest Corner of Chamberlain Street and Stanton Avenue in Ames, Iowa: The South Thirty-five (35) Feet of the North Four Hundred Nine (409) Feet of Lot One (1) , Parker' s Addition to Ames, Iowa. The one (1) parking space provided for hereunder shall at all times be clearly marked as such by the grantors, and the grantors shall maintain the said space, and access routes to and from the space, in a passable and usable condition, clear of snow accumulations, ponded water, ruts, or other conditions that could impede or discourage the use of the space. The foregoing shall be a convenant running with the real estate located at the Northwest Corner of Chamberlain Street and Stanton Avenue in Ames, Iowa, and last above-described, and it shall be binding on all owners of the land, their successors and assigns. If the rights to park on said premises hereby granted are defeased or "cut off" through mortgage foreclosure or other process, the grantors shall be bound to provide replace- ment parking rights under similar terms at a site within 300 feet of the property described on Exhibit "A" , attached hereto and made a part hereof. The foregoing may be released by resolution of the Ames City Council if alternative arrangements for parking are made elsewhere within 300 feet of the property described on Exhibit "A" , attached hereto and made a part hereof.
