HomeMy WebLinkAbout~Master - Utility - Ames/ISU YMCAr — - . .1 ELECTRIC • �� INST# 042�5 o FEE$ d .4 w� UTILITY RIGHT OF WAY PERMIT AND EASEMENT THE _Ames-isTjYMCA, its successors and assigns, in consideration of the sum of One Dollar and other considerations, receipt of which is hereby acknowledged, do grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to con- struct, reconstruct, maintain and use electric lines, consisting of poles, wires, cables, conduits, fixtures, anchors and other similar equipment, including the right to trim or remove trees within such area where necessary to secure a clearance of 4 feet from the wires or poles, and a right of access for mobile equipment and vehicles, together with the right to extend to telephone, telegraph, television, electric or power companies, or a company, the right to use separately or jointly with the City of Ames the areas included in this easement for the purposes above enumerated, over, upon, across or under the real estate, situated in the City of Ames, County of Story, State of Iowa, shown and described by the plat and descriptions attached hereto and by this reference incorporated herein and made a part hereof. It is further promised by grantor that there shall be no construc- tion or erection of any building or structure on the described land or at any other place where any part of such structure will be closer to the said wires, conduits, cables, etc. than is allowed by the National Electric Safety Code, ANSIC-2. Fences and materials storage is permit- ted, but removal will be prompt on request of the grantee for exercise of rights herein stated. The foregoing rights are granted upon the express condition that the City of Ames will assume responsibility for all damage to the above described property caused by the City' s failure to use due care in the exercise of its granted right. Permanent easement strips, across part of the Southeast Quarter (SEJ) of the Northwest Quarter (NWJ) AND part of the Southwest Quarter (SWJ) of the Northeast Quarter (NEJ) , all in Section 10 - T83N - R24W of the 5th P.M. , in the City of Ames, Story County, Iowa; described as follows: #1 . Transmission Line Easement A Ten (10) foot wide easement, Five (5) feet on each side of the following described centerline: "Commencing at the Northwest (N.W. ) corner of the SWJ-NEJ of said Section 10; thence N 890 281 06" E, 25.00 feet along the north line of the SWJ-NEJ; thence S 000 33 ' 10" E, 45.00 feet along the west line of South Riverside Drive, to the Point of Beginning; thence N 890 281 06" E, 46.24 feet (to a point designated "A" ) ; thence continuing N 89° 28' 06" E, 161 .69 feet (to a point designated "B") ; thence continuing N 890 281 06" E, 266.89 feet to the northwesterly right-of-way of Relocated South 4th Street, and the Point of Ending.
