RIGHT OF WAY PERMIT AND EASEMENT FEE$ J1
Know all persons by these presents that J. Crosby Eldredge does hereby
grant and convey to City of Ames, a permanent easement and right—of—way in
which to construct, reconstruct, operate, remove, repair, and maintain
underground pipelines and mains for the conveyance of sewage and control
cable in, over, across, through and under the following described real
property:
Description
A permanent easement described as follows:
Beginning at a point 160' north of the W'k corner of Section 30 T83N R23W
and running Lhence south 570 29' 19" east to the north right—of—way line of
County Road E-57. Thence west along said north right—of—way line to the
west line said Section 30, thence north 160' to the point of beginning all
located in Lot 1 in the SWk NW'k Section 30 T83N R23W of the 5th P.M. and
containing 0.20 acres more or less.
Reserving, however, in and to J. Crosby Eldredge, the right at all times to
enter upon and occupy the said real property or any part thereof and make
any proper use thereof so long as said occupancy and use do not infringe
upon, hinder, or limit the right herein granted to said City to construct,
reconstruct, operate, remove, repair, and maintain the said underground
sewer line and control cable.
The foregoing rights are granted upon the express condition that the City
of Ames, Iowa, will assume all liability for all damages to the above de—
scribed property caused by the City's failure to use due care in its exer—
cise of the rights granted, including any damage to crops, pasture, trees,
or fences.
