POTTER, Recorder By Deputy THIS EASEMENT AGREEMENT, made this � day of May, 1986, by and between FRED LANGE and MILDRED LANGE, husband and wife, party of the first part, and THE CITY OF AMES, IOWA party of the second part, WITNESSETH: WHEREAS, the party of the second part has acquired fee title to the land hereinafter described; and, WHEREAS, the party of the first part desires to use said land as a route of access to farm land lying to the east and south thereof; and, WHEREAS, the party of the second part is willing to grant and permit such farm access for the consideration hereinafter stated and subject to the terms and conditions hereinafter provided; NOW, THEREFORE, the parties hereto have agreed and do agree as follows: 1. In consideration of payment to the party of the second part of the sum of One Thousand Dollars ($1,000.00), receipt of which is hereby acknowledged, the party of the second part hereby grants to the party of the first part, and to their heirs, successors and assigns, the right, permit, and easement for ingress and egress over land described as: "The east- 20 feet of the south 317.4' of the north 350.4' and the east 15 feet of the south 1957.95' of the north 2308.35' all in the east 1/2 of the east 1/2 of Section 11, T83N, R24W of the 5th P.M. , Story County, Iowa, as shown on the attached plat," solely for the purpose of growing and harvesting agricultural crops on adjacent land to the east and south, subject to the conditions and provisions hereinafter stated. 2. The foregoing easement shall not be used at such times as when the party of the second part reasonably determines that such use will impede and interfere with the construction, operation or maintenance of any wells, pipelines, roadways or appurtenances thereof. 3. The party of the ,second part shall have and retain the right to fence and gate any part or all of the land subject to the foregoing easement, but they shall promptly open such gate as requested at reason- able times by the party of the first part to exercise the easement rights herein granted. 4. The party of the first part shall be responsible for cautious and safe operation of its farm equipment through the easement area WK 2 PAGE 4 described above and shall compensate the party of the second part for any loss or damage caused to the party of the second part by the actions and operations of the party of the first part on said access route. Additionally, the party of the first part shall hold the party of the second part harmless from and indemnify against any and all claims, losses, demands and suits resulting from or arising out of the use of said access route by the party of the first part. 5. This easement agreement shall be a covenant running with the land and shall be binding upon the parties hereto, and upon their heirs, successors and assigns.
