KNOW AtL MEN BY THESE PRESENTS:
That (I/we) , E.J. Litzel and Margaret E. Litzel, husband and wife,
in consideration of the sum of One Dollar and other good and valuable
consideration, the receipt of which is hereby acknowledged, (do/does)
hereby grant unto the City of Ames, Iowa, a municipal corporation,
its successors and assigns, the perpetual right to enter upon the
land described and the perpetual right to construct, reconstruct,
clean up, operate, maintain, and cover over and repair a
_sanitary sewer upon, under and across the land described
as follows:
A temporary construction easement 20' in width and a
DESCRIPTION: permanent easement 10' in width centered on a line more
particularly described as follows: Beginning at a point 5' south and 30'west of the
Southeast Corner of Lot 1 , Dover Drive Estates Subdivision and running thence North
730 42' East 30' , thence North 780 14' East 296' to a point 30' East and 5' south of
the Southwest Corner of Lot 5, Dover Drive Estates Subdivision. Also, beginning at
a point 30' east and 10' south of the Southwest Corner of Lot 4, Dover Drive Estates
Subdivision and running thence South 070 16' East 229' to a point 10' south of an
existing manhole on Clear Creek sanitary sewer outfall line. All located in the City
of Ames, Story County, Iowa and containing 0.25 acres and 0. 12 acres respectively.
See attached plat marked Exhibit A and made a part hereof.
There is also hereby granted a right of ingress and egress over
and across adjacent land and a temporary right of encroachment over
and across adjacent land on either side of the above described line
only during the period of construction.
The foregoing rights are granted upon the express condition that
the City of Ames, Iowa, will assume all liability for all damages to
the above described property caused by the City ' s failure to use due
care in its exercise of the rights � ted.
