SANITARY SEWER EASEMENT Q
KNOW ALL PERSONS BY THIS INSTRUMENT: That we , the under-
signed, sometimes hereinafter referred to as GRANTOR, in con-
sideration of One Dollar and other good and valuable consider-
ation, do hereby grant unto the City of Ames , Iowa, a municipal
corporation, its successors and assigns , hereinafter referred
to as GRANTEE, upon the conditions hereinafter recited, the
perpetual right to enter upon the land hereinafter described
for the purposes of this easement and the perpetual right to
construct, reconstruct, cover over, clean up , operate, use,
maintain and repair a sanitary sewer over, upon, across and
under a strip of land situated in Story County, Iowa, described,
as follows :

A permanent easement ten (10) feet on each side (4nd a
temporary construction easement twenty-five (25) feet on'
each side) of a centerline described as beginning at a
point on the West line of the Northeast Quarter (NE1/4)
of Section 27 , Township 84 North, Range 24 West of the
5th P .M. , Story County, Iowa, which is 1, 366 . 75 feet
North 00°24 '20" East of the Southwest Corner of said
Northeast Quarter (NEl/4) ; thence North 67°28 ' 40" East
264. 7 feet ; thence East 130 . 0 feet ; thence North 17°20 '
00" East 613. 2 feet to the point of ending, all as shown
on the survey plat attached hereto marked EXHIBIT A.
(The above described bearing of North 17020 '00" East
equals the bearing of North 19°39 '45" East as the lat-
ter appears on the survey plat filed in the office of
the Recorder of Story County, Iowa, on October 29 ,
1973, and recorded in Book 123 of Miscellaneous Records
at. Page 71. )
The foregoing rights are granted by the undersigned and
shall be accepted and exercised by Grantee, subject to perform-
ance by Grantee , of the following terms and conditions :
1. Grantee shall assume responsibility for all damage to
the above described real estate caused by its failure to use
due care in the exercise of the rights granted herein.
2 . Immediately following installation, reconstruction or
repair of the aforesaid municipal utility service, weather and
season permitting, the ground disturbed by construction activ-
ity shall be restored to its natural grade and previous condi-
tion.
