Mason (do/daex) hereby grant unto the City of Ames , Iowa, a municipal corporation, its successors and assigns , the perpetual right to enter upon the land described and the perpetual right to construct , reconstruct, clean up , operate, maintain, and cover over and repair a sanitary, sewer upon, under and across the land described as follows : DESCRIPTION: A permanent easement 10 feet in width (bounded on both sides by a 15 feet wide temporary construction easement) bordered on the North by an existing sanitary easement and on the South by the north property line of Outlot A and centering,on a line more particularly described as follows : Commencing at the intersection of .the centerline of Section 4, Township 83 North, Range 24 West of the 5th ,P.M. , City of -Ames, Story County, Iowa and the West line of Hyland Avenue as established by a survey made for the City of Ames in 1967, said point being 397.2 feet Westerly of the Southeast Corner, Southwest Quarter, Northwest Quarter of Section 4, thence South 00 29' 30" West along the West line of Hyland Avenue, 251.43 feet;. thence North 890 50' 40" West, 173.0 feet to the point of beginning; thence North 210 00' 00" West for a distance of 50 feet more or less to the South line of the existing easement. Containing approximately 0.02 acres. See attached plat marked and made a part hereof. The foregoing rights ate granted upon the express condition that the City of Ames , Iowa, will assume all liability for all damages to the above described property caused by the City' s failure to use due care in its exercise of the rights granted.
