KNOW ALL PERSONS BY THESE PRESENT'S: That we, the undersigned,
in consideration of the surer of $800 and other good and valuable
consideration, do gereby grant unto the City of Ames, Iowa, a
municipal corporation, its successors and assigns, upon the
conditions reinafter recited, the perpetual right to enter
upon the land hereinafter described for the purposes of this
easement and the perpetual right to construct, reconstruct,
clean up, operate, maintain, use, cover over and repair a san-
itary sewer over, upon, under and across a strip of land sit-
uated in Story County, Iowa, described as fbllowst

The foregoing rights are granted by the undersigned and
shall be accepted and exercised by the City of Ames, Iowa,
sub3ect to performance by the City of Ames, Iowa, of the
following terms and conditions:
1. During all construction activity a temporary bound-
ary fence, such as a snow fence, shall be kept in place along
the perimeter boundaries of the temporary construction ease-
ment shich will conf ue all construction activity to said
easement area and still permit grantors vehicular access to
their residence.
2. Except within the area of said temporary construc-
tion easement, no construction equipment shall be driven up-
on or transported over the asphalt drive extending northerly
from grantors' residence, to, Qntario Street.
3. If saidasphalt drive should bcgome temporarily un-
usable due to '`construciion. activity or the exercise of other
rights granted' abov'e, grantors shall' at all such times be
provided with a .temporary alternate all-weather vehicular
access between: their residence- and Ontario Street.
4. Ic ned rely f+oLlowcipg .L,�stallation of said sanitary
sewer, weather permittingi the ground disturbed by donstruc
tion activity shall be restored to its natural grade.
5. Immediately following �asta. lation of said sanitary

sewer, weather permitting, all d.ama.ge caused by constructian '
activity to the asphalt drive extending northerly from grant-
ors ' residence to untario Street shall be repaired and said
asphalt drive and associated drainage structures and adjacent
fences shall be restored to a condition equal to or better
than that which existed prior to the commencement of construe-
tion. Thereafter, for a Period of twelve months, the City of
Ames, Iowa, shall be responsible for correction and repairing
any part of said asphalt drive that is damaged by reason of
settlement of earth fill over said sanitary sewer.
6. Immediately following installation of said sanitary
sewer. we atlaer and season. Derr dtti ng, ground areas disturbed
by construction activity shall be planted with grass seed in
accordance with standard, methods of soil preparation and
planting. Kentucky bluegrass shall be olanted adjacent to
said asphalt drive for a depth of ten feet and Reeds canary
grass shall be planted in all other areas
7. The City of Ames, Iowa, will assume responsibility
for all damage to the above describe-1 rea.l estate caused by
its exercise of the rights granted herein.
8. The City of knes, Iowa, will permit grantors', as the
owners of the principal tract of land traversed by the afore-
said easement, their successors and assigns, to install and
connect to the Clear Creek sanitary sewer trunk line, with-
out assessment of any municipal connection fees, sanitary
sewer lines serving two single family dwellings located on
said principal tract. -
