HomeMy WebLinkAboutA001 - Easement dated August 20, 1957 r Instr. +7678 EASEMENT AGREEMENT Fee $1.80 KNOW ALL MEN BY THESE PRESENTS : This agreement made and entered into this ".6L y of August, 1957, by and between the City of Ames, Iowa, hereinafter referred to as First party, and Gunder Fjare and Jane Fjgre, husband and wife, and Milford A, 8jare and Maxine Fjare, husband and wife, hereinafter referred to as Second Party; WITNESSETH; WHEREAS on November 26, 1956 the second party executed and delivered to first party a storm and sanitary easement filed December 219 1956 in record book 80, page 217�, and WHEREAS the Engineering Department of the City of Ames, with the approval and consent of second party, approved and allowed the construction of the storm and sanitary sewer oven; across and under an area of land slightly different from the area described in the easement recorded in Book 80.. page 217. NOW THEREFORE, in consideration of One ($1.00) Dollar and other valuable considerations, receipt of which is hereby acknowledged, it is agreed as` follows; 1. In consideration of the ,premises, first party reline» quishes and renounces any easement rights which it now owns over, across and under the area affecting lots 18, 19, 20, 21 and 23 of First Subdivision of Gunderland Heights Addition to Ames, Iowa, granted in the easement dated November 26, 1956, filed December 21„ 1956 and recorded in Book 80, page 217. 2. That in consideration of the premises, the second party hereby grants to first party, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use its underground storm and sanitary sewer and all equipment necessarr for the said sewers over, across and under the following described real estate: The East 7,5 feet of the South 35.5 feet of Lod 18; A 15 foot easement running parallel to the East line of Lots 18, 19 and 20, the East line of said easement being located 7.5 feet West of the East line of said lot; s r A triangular tract of land commencing on the North line of Lot 200 90.0 feet West of the Northeast corner thereof, thence East along the North line of said lot, 67.5 feet; thence South parallel to the East line of said lot, 25*0 feet; thence in a Southwesterly direction on a straight line to the point of beginning; A 15 foot easement on Lot 21, the East line of which is described as follows: Commencing on the South property line of Lot 21, 70.0 feet West of the Southeast corner thereof; thence in a Northwesterly direction to a point on the North line of Lot 21, 90.0 feet West of the Northeast corner of said lot; A 7.5 foot easement along the Southeast boundary line of Lot 21; and The South 50 feet of Lot 23, All in First Subdivision of Gunderland Heights Addition to Ames, Iowa, That the easement right is granted upon the express con- dition that the City of Ames will assume liability for all damage to the hereinbefore described property caused by said city's failure to use due care in their exercise of the granted right.
