See attached plat marked Exhibit A and made a part hereof. There is also hereby granted a right of ingress and egress over and across adjacent land and a temporary right of encroachment over and across adjacent land on either side of the above described line only during the period of construction. The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume all liability for all damages to the above described property caused by the City' s failure to use due care in its exercise of the rights granted.
