WHOM Recorder PERMIT Or.,,..,.,........................... .......»�aP�d For use of property owned by the State of Iowa and under the jurisdiction of the Iowa State Highway Commission for utilities accommodation. (Non-Right of way) . Approval is hereby given to the City of Ames, Iowa, a municipal corporation, its successors and assigns to construct, reconstruct, clean up, operate, cover over, maintain and repair a sanitary sewer upon, under and -across the land described as follows: SOUTH OAK AVENUE 10 feet each side of a line beginning at a point on the centerline of South Oak Avenue 25 feet South of the intersection of South 4th Street and South Oak Avenue; thence continuing South 335 feet + in the Northeast 1/4 Section 10-83-24, 5th P.M. , Story County, Iowa. (See attached plat marked Exhibit "A" and made a part hereof) . subject to the following terms and conditions agreed to as follows: 1. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the current Iowa State Highway Commission Utility Accommodation Policy as applicable. 2. The installation shall meet the requirements of local, muni- cipal, county, state and federal laws, the Iowa State Department of Health, all rules and regulations of the Iowa State Highway Commission, and any other laws or regulations applicable. 3. The Permittee shall be fully responsible for any future adjust- ments of its facilities within the state owned property caused by Highway Commission construction or maintenance operations upon the property. 4. The Iowa State Highway Commission shall give the Permittee at least 48 hours written notice of any proposed construction or maintenance work that is likely to conflict with the installation belonging to the Permittee, in order that Permittee may arrange to protect its facilities. 5. The State of Iowa and the Iowa State Highway Commission assume no responsibility for damages to the Permittee' s facility occasioned by any construction or maintenance operations by the State or Commission. 6. The Permittee agrees to give the Iowa State Highway Commission 48 hours notice of its intention to start construction. Said notice shall be made in writing to the Director of Facilities Man4.gement, Ames, Iowa. 7. The Permittee agrees to, at all times, give the Iowa State Highway Commission timely notice of intention to perform routine -1- r ' 4 maintenance within the state owned property. Said notice shall be given to the Director of Facilities Management , Ames, Iowa. 8. Operations in the construction and maintenance of said utility installation shall be carried on in such a manner as to cause a minimum of interference to the use of the property by the State. 9. The Permittee shall be responsible for any damage that may result because of the construction, operation, or maintenance of said utility, and shall reimburse the State of Iowa or the Iowa State Highway Commission for any expenditure that the State of Iowa or the Iowa State Highway Commission may have to make because of said Permittee's utility having been constructed, operated or maintained thereon. 10. The Permittee shall indemnify and save harmless the State of Iowa and the Iowa State Highway Commission from any and all causes of action, suits at law, or in equity, or losses, damages, claims, or demands, and from any and all liability and expense of whatsoever nature for, on account of, or due to the acts or omissions of said Permittee' s officers, members, agents, representatives, contractors, employees or assigns arising out of or in connection with its use or occupancy of the State property under this permit. 11. Non-compliance with any of the terms of the Highway Commission policy, permit, or agreement, may be considered cause for shut-down of operations until compliance is assured, or revocation of the permit. The cost of any work caused to be performed by the State in removal of non-complying construction will be assessed against the Permittee. 12. The Permittee is granted a right of reasonable ingress and egress over and across adjacent state land and a temporary right of encroachment over and across adjacent land on either side of the above-described line during the period of construction.
