KNOW ALL MEN BY THESE PRESENTS: By .Deputy
That we, Roland L. and Ann L. McCormack, husband and wife,
in consideration of the right to make without charge two sanitary
sewer connections to the Skunk River Outfall. Sanitary Sewer in
the hereinafter described area, which right is also granted to
successors and assigns, do hereby grant unto the City of Ames,
Iowa, a municipal corporation, its successors and assigns, the
perpetual right to enter upon the land described and the per-
petual right to construct, reconstruct, clean up, operate, main-
tain, and cover over a repair a sanitary sewer upon, under and
across the land described as follows:
DESCRIPTION
35 ' East of and parallel to the East line of Lew Cole' s
Subdivision described as beginning at the Southeast corner of
Lew Cole' s Subdivision; thence North 0018' East 715 .5 ft.
See attached plat marked Exhibit A and made a part hereof.
There is also hereby granted a right of ingress and egress
over and across adjacent land and a temporary right of encroach-
ment over and across adjacent land on either side of the above
described line only during the period of construction.
The foregoing rights are granted upon the express condition
that the City of Ames, Iowa, will assume all liability for all
damages to the above described property caused by the City' s
failure to use due care in its exercise of the rights granted.
