Larson, husband and wife, in con- sideration of the sum of One Dollar and other good and valuable consideratioi, the receipt of which is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to enter upon the land described and the perpetual right to construct, reconstruct, clean up, operate, maintain, and cover over and repair a sanitary sewer upon, under and across the land described as follows: Commencing at the Northwest corner Lot 3, 'ChristensenIs Timberlane Heights Subdivision, thence N 46016' E, 61. 0 feet; thence Westerly along a line which lies parallel to the East-West centerline Section 16, Township 83 North, Range 24 West a distance of 94. 91 feet to the point of beginning; thence ten (10) feet on either side of a line described as 991 241 left, 41. 74 feet; thence 1 2 05 7 140 11 right a distance of 14.0--,feet more or less; to a line which is parallel to the East- West centerline of said Section 16, and intersects the South- west corner said Lot 3. There is also hereby granted a right of ingress and egress over and across adjacent land and a temporary right of encroachment over and acrosE adjacent land on either side of the above described line only during the periol of construction. The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume all liability for all damages to the above described property caused by the Cityrs failure to use due care in its ex- ercise of the rights granted.
