F. H. Tiffany and Lois H. Tiffany, husband and wife, in consideration
of the sum of One Dollar and other g-_)od and valuable consideration, the
receipt of which is hereby acknowledged, do hereby grant unto the City of
Antes, Iowa, a municipal corporation, its successors and assigns, the
perpetual right to enter Upon the lAnd described and the perpetual right to
construct, reconstruct, clean up, operate, maintain, and cover over and
repaik a sanitary sewer upon, under, and across the land described as
follows:
Ten (10) feet on either side of a line described as commencing
at the Southwest corner Lot 5, Christensen's Timberlane Sub-
division, thence S 360511 W, 91. 2 feet; thence Westerly along a
line while lies parallel to the East-West centerline of Section 16,
Township 83 North, Range 24 West, a distance of 94. 91 feet;
thence 800361 to the right, 107. 01 feet; thence 5018r40" to the
left; 45 feet more or less to the point of beginning which lies on
a line that is parallel to the East-West centerline of said Sec-
tion 16 and passes through the Southwest corner Lot 6 said
Subdivision; thence continuing on th-, same bearing line Westerly
to a line which is parallel to the East-West centerline of said
Section 16 and intersects the Northwest corner of said Lot 6,
a distance of 98 feet more or less.
There is also hereby granted a right of ingress and egress over and
across adjacent land and a temporary right of encroachment over and
across adjacent land on either side of the above described line only during
the period of construction.
The foregoing rights are granted upon the express condition that the
City of Ames, Iowa, will assume all liability for all damages to the above
described property caused by the Cityis failure to use due care in its ex-
ercise of the rights granted.
