Voglmer A. Fassel & Mary K. Fassel, husband and wife, in consider-
ation of the sum of One Dollar and other good and valuable consideration,
the receipt of which is hereby acknowledged, do hereby grant unto the City
of Ames, Iowa, a municipal corporation, its successors and assigns, the
perpetual right to enter upon the land described and the perpetual right to
construct, reconstruct, clean up, operate,..maintain, and cover over and
repair a sanitary seweir upon, under and across the land described as

Commencing at the Northwest corner, Lot 3, Christensen's
Timberlane Heights Subdivision; thence N 460161 E. , 61. 0
I feet to a point which lies on a line which is parallel to the East-
West centerline of Section 16, Township 83 North, Range 24
West; thence Westerly 94. 91 feet along said line; thence 990
24' left, 41. 47 feet; thence 12057140" right a distance of 140
feet more or less to the point of beginning, said point lying
on a line which is parallel to the East-West centerline said
Section 16 and intersects the Southwest corner said Lot 3;
thence ten (10) feet on either side of a line described as con-
tinuing the same bearing a distance of 63 feet more or less; j
thence 8705514011 right, 559. 53 feet; thence 60521201 left, a
distance of 200 feet more or less to a point on the East Right- i
Of-Way line of the former Ft. Dodge, Des Moines & Southern
Railroad now owned by the City of Ames, Iowa, said point being
45 feet more or less Southwesterly from the intersection of
said Right-Of-Way line and said East-West Centerline Section 16.
There is also hereby granted a right of ingress and egress over and
across adjacent land and a temporary right of encroachment over and acros
adjacent land on either side of the above described line only during the
period of construction.

The foregoing rights are granted upon the express condition that the
City of Ames, Iowa, will assume all liability for all damages to the above
described property caused by the City's failure to use due care in its ex-
ercise of the rights granted.
