and other good and valuable consideraion, the receipt of which is hereby
acknowledged, does hereby grant unto the City of Ames, Iowa, a municipal
corporation, its successors and assigns, the perpetual right to enter upon
the land described and the perpetual right to construct, reconstruct, clean
up, operate, maintain, and cover over and repair a sanitary sewer upon,
under and across the land described as follows:
Ten (10) feet either side of a line described as commencing
at the Southwest corner Lot 5, Christensen's Timberlane
Subdivision, thence S 360511 W, 91. 2 feet; thence Westerly
along a line which lies parallel to the East-West centerline
of Section 16, Township 83 North, Range 24 West, a distance
of 94. 91 feet to the point of beginning, thence 800361 to the
right, 107. 01 feet; thence 5018140/1 to the left, 45 feet more
or less; to a line which is parallel to the East-West centerline
of said Section 16 and intersects the Northwest corner of said
Lot 5.
There is also hereby granted a right of ingress and egress over and across
adjacent land and a temporary right of encroachment over and across adja-
cent land on either side of the above described line only during the period
of construction.
The foregoing rights are granted upon the express condition that the
City of Ames, Iowa, will assume all liability for all damages to the above
described property caused by the Cityps failure to use due care in its ex-
ercise of the rights granted.
