Kurtz (husband and wife) in consideration of the sum :of One Dollar and other good and valuable consideration, the re- ceipt of which is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to enter upon the land described and the perpetual right to construct, reconstruct, clean up, operate, maintain, and cover over and repair a sanitary sewer upon, under and across the land described as follows: Beginning 10 feet East of the Northwest corner, Lot 3, Home- wood Addition to the City of Ames, Iowa, thence South 80 feet, thence East 5 feet; thence South 5 feet, thence East 10 feet, thence North 85 feet, thence West 15 feet to point of beginning. There is also hereby granted a right of ingress and egress over and across adjacent land and a temporary right of encroachment over and across adjacent land on either side of the above described line only during the period of construction. The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume all liability for all damages to the above described property and any improvements thereon caused by the City in its exercise of the rights granted. As further consideration for the granting of this easement, the City shall install a wye in the sanitary sewer line at a point approximately 25 feet North of the South line of said Lot 3, Homewood Addition.
