Dayton Road Development Corporation in consideration of the sum
of One Dollar and other good and valuable consideration, the receipt of
which is hereby acknowledged, do hereby grant unto the City of Ames,
Iowa, a municipal corporation, its successors and assigns the perpetual
right to enter upon the land described and the perpetual right to construct,
reconstruct, clean up, operate, maintain, and cover over and repair a san-
itary sewer upon, under and across the land described as follows:
Commencing at the Northeast corner of Section 1,
Township 83 North, Range 24 West of the 5th P. M. ,
Story County, Iowa; thence South along the Center-
line of Dayton Avenue 788. 93 feet, thence West 450
feet to the Point of Beginning; thence North 16023'
51" West 271. 05 feet; thence East 5. 21 feet; thence
North 5700415411 East 6. 59 feet; thence South 16023'
511 East 239. 90 feet; thence South 35. 42 feet to the
Point of Beginning.
There is also hereby granted a right bf ingress and egress over and
across adjacent land and a temporary right of encroachment over and a-
cross adjacent land on either side of the above described line only during
the period of construction.
The foregoing rights are granted upon the express condition that the
City of Ames, Iowa, will assume all liability for all damages to the above
described property caused by the City's failure to use due care in its,ex-
ercise of the rights granted.
