construct, reconstruct, operate, maintain, repair and rare a

Beginning at existing Squaw Creel, Sanitary Magbolea No. 18t
located approximately 1,760 feet West and 200 feat South of
the Northeast corner of the SW 1/4, U 1/4, Section 33,
Township 64 North, Ran" 24 West, thence North 19016'15"
West 360.4 feast, theme North 9034115" West 630.93 foot,
thence North 53005145" Vest 81.77 feet, tbswo North 33 '1S"
West 396.09 foot.
The foregoing right is granted upon the following express con-
41tions, the breach of any of which will give the State BoArd of
Regents the right %aad power to re-entort.
(1) That the said City shall construct, operate and maintain
said sanitary sewer in a: manner consistent with eao al and
accepted practices of the industry;
(2) Thx t upon completion of said construction or upon com-
pleation of say reconstruction, repair, a eaintonaa►a►ces, or removal of

said sanitary sever the said City shell replace, restore, or
pay to the sxatisfactba of the Iowa States University any and all
dar gee to the peroperty of said State of lowa which shall be
ocoasioned by the said construction,, reconstruction, repair,
maintenance, operation or removal of said sanitary suer through
tbet premises above-described;
(3) That said City will parotect, indemnify and save harmless
the State of love, the State Board of Regents aad lam Mate
University from any and all claim, demands. judgmats, lose. .
cost or expense for injury to or death of persons, or da>aage to
property of any person whomsee r (including employees and ree-
peres+sntativees of berth partisos hereto) in any manner arising from
or growing out of the negligence eof the said City, its agents,
servant* or employees, in the construction, m ainten aetce, repair,
eaeistouce, use or reesa val of said sanitary sewer herein permitttd;
(4) That none of they covet of constructing, reconstructing,,
operating,, maintaining or repairing said sanitary sensor shall be
charged or assessed against wAjac eat property of the State hoard
of Reegents# Iowa State University of Sscienco and Te cho ology, or
the State of Iowa;
(S) That said City shall not transfer or &*sign this ease-
ment or .slay interest or right therein without the written *on-
seat of the grantor# nor shall then coassent of the grantor to such

or different rights than those hereby given to said City;
(b) In the event the said Cite* or any assigoee thereof

this easement shall terminate, and said City or assigsame shall,
