HomeMy WebLinkAbout~Master - Sanitary Sewer - Fuller Inst # 13334 w _ ' ROOK. 7 PAG Fee $ 2.50 RIGHT OF WAY PERMIT AND EASEMENT We, Charles Fuller and Emma Fuller, husband and wife, in consideration of the sum of one dollar and other valuable consideration,- the receipt of which is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the right to enter upon the land described as: The East 150 feet of the South 180.4 feet of the North 290.4 feet of the Northeast Quarter of Section.111, Town- ship 83 North, Range 24 West of the 5th P. M. , Iowa, and the perpetual right to construct, reconstruct, clean up, and operate, maintain, cover over and repair' a sanitary sewer upon, under and across said land for a distance of ten (10) feet on the West side of said sewer line located upon the land above described in approximately the following line : Beginning at a point 110 feet South of the Northeast corner of Section 11, Township 83 North, Range 24 West of the 5th P. M. , Iowa, thence South 1.80.4 feet. The foregoing right is granted upon the express condition that the City of Ames, Iowa, will assume liability for all damgges to the above described property caused by said City' s failure to use due care in its exercise of the right granted, and will repair the road adjacent to said sewer if damaged.
