HomeMy WebLinkAbout~Master - Sanitary Sewer - Krocheski Inst # 1334 RIGHT OF WAY PERMIT AND EASEMENT Fee $ 2 . 50 We, Frank Krocheski and Agnes Krocheski, husband and wife, in consideration of the sum of one dollar and other valuable considera- tion, the receipt whereof is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, a municipal corporation, its successor and assigns, the right to enter upon the land described as: The South 1310.7 feet of the West Half of Section 12 and the South 1310.7 feet of the East Half of Section 11, all in Township 83 North, Range 24 West of the 5th P. M. , Iowa, and the perpetual .right to construct, reconstruct, clean up, operate, maintain, cover over and repair a sanitary sewer upon, under and across said land for a distance of ten (10) feet on each side of said sewer line located upon the land above described in approximately the following line : Beginning at a point 33 feet North of the Southwest corner of Section 12, Township 83 North, Range 24 West of the 5th P. M. , Iowa, thence North 1277. 7 feet. There is hereby granted also a temporary easement over and across an additional 30 feet on the East side of the above said sewer line for construction purposes until August 1, 1960. The foregoing right is granted upon the express condition that the City of Ames, Iowa, will assume liability for all damages to the above described property caused by said City' s failure to use due care in its exercise of the right granted, and will replace all top soil disturbed to the depth of ten (10) inches in cultivate land.
