J J + Fjare and Maxine Fjare, husband and wife, of Story County, Iowa, in consider- ation of the sum of One ($1.00) Dollar, receipt of which is hereby acknowledged do hereby grant to the City of. Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct and maintain and use its electric lines, consisting of poles, wires, overhead or underground cables, fixtures, anchors and other similar equipment for the sole purpose of conveying electric current for power and lighting purposes, together with the right to extend to any telephone company, electric or power company the right to use jointly with the grantee any pole placed pursuant to the provisions hereof, or to use any of the land embodied by this easement, to- gether with the right to trim any trees where necessary to secure adequate clearance for the safe operation of the electric lines upon, underground or adjacent to the following described real estate: The South 5 feet of Lots 1, 2, 3 and 4; & 10 feet along the East boundary lines of Lots 13, 14 , 15Aand 17; 10 feet along the South Boundary lines of Lots S, 9, 11 and 13; The Kest 10 feet of Lots !, 1, 6, 7 and "8; The North 5 feet of Lots 5 and 6; 5 feet along the East boundary line of Lots 9 and 10, and 8 feet along the West boundary line of Lots 11 and 12, All within Second Subdivision of Gunderland Heights Addition to the City of Ames, Iowa. The foregoing right is granted upon the express condition that the City of Ames will assume liability for all damage to the hereinbefore describe property caused by said city's failure to use due care in i;ts excersise of the granted right.
