RIGHT OP WAY PERMIT AND EASEMENT
We, Harold B. Ellis and Virginia A. Ellis, husband and wife, in
consideration of the sum of One Dollar and other good and valuable consider-
ation, the receipt of which is hereby acknowledged, do hereby grant to the
City of Ames.. Iowa, a municipal corporation, its successors and assigns,
the right to enter upon the land described and the perpetual right to construct,
reconstruct, clean up, operate, maintain, cover over and repair a sanitary
sewer upon, under and across the land described as follows:
Ten feet on each side of a line described as commencing
at a point 1432 feet North and 22 feet West of the Southeast
corner Section 6-83-24, thence North 660 34' 30" West
400 feet, thence South 66° 36' 30" West 331 feet, thence
South 490 18' West 340 feet, thence North 760 15' West
260 feet, thence North 240 57' West 227 feet, thence North
370 18' 30" West 162. 5 feet, thence North 480 20' 30" WEst
81. 5 feet to e South line of Lot 6C Damon Catron's Sub-
division in 44 NW 1/4 SE 1/4 and NE 1/4 SE 1/4 said
Section 6 to beginning, thence continuing North 480 20' 30"
West 201. 2 feet to the West City of Ames corporation line.
There is also hereby granted a temporary right of encroachment
over and across adjacent land on each side of the above described line for
construction purposes.
After construction of said sewer, nothing in this easement shall
exclude plantings or structures,in said easement area, except permanent
structures which would impose undue additional loads upon said sanitary sewer.
The foregoing rights are granted upon the express condition that
the City of Ames, Iowa will assume liability for all damage to the above de-
scribed property caused by said city's failure to use due care in its exercise
of the rights granted.
