Litzel, husband and wife for and in consideration of the sum of One Dollar and other valuable consideration, the receipt of which is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns; the right to enter upon the land described and the perpetual right to construct, reconstruct, clean up, operate, maintain, cover over, and repair a sanitary sewer, upon, under and across the land described as follows: Ten feet on each side of a line described as commencing at a point 1, 432 feet North and 22 feet West of the South- east corner Section 6--83--24, thence North 660 34' 30" West to the West line of Delaware Avenue to beginning, thence continuing North 660 34' 30" West 372 feet, thence South 660 36' 30" West 140 feet to the South line of Lot 9 (c) Damon Catron Subdivision in the City of Ames, Iowa. and Ten feet on each side of a line described as commencing at a point 1, 432 feet North and 22 feet West of the South- east corner Section 6--83--24, thence North 660 341 30" West 400 feet, thence South 660 36' 30" West 140 feet to the North line of Lot 9 in NE 1/4 SE 1/4 said Section 6 to beginning, thence continuing South 660 36' 30" West 191 feet, thence South 490 18' West 70 feet to the West line of said Lot 9. There is also hereby granted a temporary right of encroachment over and across adjacent land on each side of the above said easement area not to exceed 10 feet on each side thereof and only during the period of construction. The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume liability for all damage to the above described property caused by City's failure to use due care in its exercise of the rights granted; that the city will replace at its cost in as good or better condition as same now exist all fences removed in said construction; and, that city will at its cost level and seed all areas damaged in said construction.
