RIGHT-OF-WAY PERMIT AND EASEMENT
Dean Flummerfelt and Erma Flummerfelt, husband and wife, in
consideration of the sum of one dollar and other good and valuable consider-
ation, the receipt of which is hereby acknowledged, do hereby grant unto the
City of Ames, Iowa, a municipal corporation, its successors and assigns, the
perpetual right to enter upon the land described and the perpetual right to
construct, reconstruct, clean up, operate, maintain and cover over and repair
a sanitary sewer upon, under and across the land described as follows:
Ten (10) feet on each side of a line described as lying
Fifteen (15) feet Southwesterly from and parallel to a
line beginning at a point in the North line of the South
Half (S 1/2) of the North Half (N 1/2) of the Southwest
Quarter (SW 1/4) of the Southeast Quarter (SE 1/4) of
Section Eleven(11), Township Eighty-Three (83) North,
Range Twenty-four (24) West of the 5th P. M. , Iowa,
and Nine hundred eleven (911) feet East of the West
line of the Southwest Quarter (SW 1/4) of the Southeast
Quarter (SE 1/4) of said 'Section Eleven (11), then South
230, 271, 18" East Three hundred sixty-three (363) feet
to a point Two hundred fifty-nine (259) feet West of the
Southeast corner of the South Half (S 1/2) of the North
Half (N 1/2) of the Southwest Quarter (SW 1/4) of the
Southeast Quarter (SE 1/4) of said Section Eleven (11).
There is also hereby granted"a temporary right of ingress and
egress over and across adjacent land and a temporary right of encroachment
over and across adjacent land on either side of the above described line only
during the period of construction.
The foregoing rights are granted upon the express condition that
the City of Ames, Iowa, will assume all liability for all damages to the above
described property caused by the city's failure to use due care in its exercise
of the rights granted.
