There is also hereby granted a right of ingress and egress over and across adjacent land and a temporary right of encroachment over and across:. ad3acent land on either, side of the above described line only during the period of construction. The f-oregoing rights are granted upon the express condition that the City 'of Ames, Iowa, will assume all liability for all damages to the above described property caused by the City' s failure to use due care in its exercise of the rights granted.
