That �-I-/we) , Merlin H. and Carrie-H. Anderson, husband and wife,
in consideration of the sum of One Dollar and other good and valuable
consideration, the receipt of which is hereby acknowledged, (do/does)_
hereby grant unto the City of Ames, Iowa, a municipal corporation,
its successors and assigns , the perpetual right to enter upon the
land described and the perpetual right to construct, reconstruct,
clean up, operate, maintain, and cover over and repair a
sanitary sewer upon, under and across the land described
as follows:
DESCRIPTION
Commencing at the Southwest corner Lot 13 Reiste' s Timberland
Heights Subdivision; thence North 2031' East 10-.0 feet to the point
of beginning 10 feet each side of a line described from the point
of beginning as follows: thence South 79058147" East 307. 48 feet;
and the West 10 feet of the East 70 feet Lot 13 Reiste' s Timberland
Heights Subdivision, located in Section 16, Township 83 North, Range
24 West of the 5th P.M. , Story County, Iowa.
See attached plat marked Exhibit A and made a part hereof.
There is also hereby granted a right of ingress and egress over
and across adjacent land and a temporary right of encroachment over
and across:. ad3acent land on either, side of the above described line
only during the period of construction.
The f-oregoing rights are granted upon the express condition that
the City 'of Ames, Iowa, will assume all liability for all damages to
the above described property caused by the City' s failure to use due
care in its exercise of the rights granted.
