KNOW ALL MEN BY THESE PRESENTS:
That (IIVO') , Nellie E. Cayler
in consideration of the sum of One Dollar and other good and valuable
consideration, the receipt of which is hereby acknowledged, (do/y7qrqrv)
hereby grant unto the City of Ames, Iowa, a municipal corporation,
its successors and assigns , the perpetual right to enter upon the
land described and the perpetual right to construct, reconstruct,
clean up, operate, maintain, and cover over and repair a
sanitary sewer upon, under and across the land described
as follows:
DESCRIPTION : 10 feet each side of a line described as follows:
Commencing at the Southwest corner of the West 179 ' Lot 13 Cayler's Sec-
ond Addition; thence North 89050 ' West 193.8 feet to the point of begin-
ning; thence continuing North 89050 ' West 219.9 feet; thence South 4*20 '
30" West 632. 83 feet to the existing 30" Beach Avenue to plant outfall.
See attached plat marked Exhibit A and made a part hereof.
There is also hereby granted a right of ingress and egress over
and across adjacent land and a temporary right of encroachment over
and across adjacent land on either side of the above described line
only during the period of construction.
The foregoing rights are granted upon the express condition that
the City of Ames , Iowa, will assume all liability for all damages to
the above described property caused by the City' ilure to use due
care in its exercise of the rights granted.
