Allen, single, in consideration of the sum of One Dollar and other valuable consideration, the receipt of which is hereby acknowledged, do hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the right to enter upon the land described, and the perpetual right to construct, re- construct, clean up, operate, maintain, cover over and repair a storm sewer and sanitary sewer upon, under and across the land described as follows: A strip of land 50 feet wide, 20 feet lying northerly of and 30 feet lying southerly of a line described as follows: Beginning 572. 9 feet north and 1123 feet west of the southeast corner of the Southwest Quarter of theNo�r.theast Quarter of Section 34, Township 84 North, Range 224 West, thence north 270 51' east 302. 3 feet, thence north 36 51:; east 174 feet, thence north 700 211 east 172 feet, thence north 890 241 east 715. 3 feet to a point 294. 8 feet south of the northeast corner of the South- west Quarter of the Northeast Quarter of Section 34, Township 84 North, Range 24 West of the 5th P. M. There is also hereby granted a temporary right of encroachment over and across adjacent land on each side of the above described line for construction purposes. The foregoing rights are granted upon the express condition that the City of Ames, Iowa will assume liability for all damages to the above de- scribed property caused by said City's failure to use due care in its exercise of the rights granted, and specifically that the City of Ames, Iowa will pay for all damage to crops during the periods of construction.
