Bliss and Patricia L. Bliss, husband and wife, Phil Coy and Sons, a partnership composed of Jack Coy and Richard Coy; Jack Coy and Elizabeth E. Coy, husband and wife; Richard Coy and Gretchen Coy, husband and wife, Gladys Allen Witter and E. W. Witter, wife and bbsband, Harriett Allen, single; Dorothy J. Allen, singly and Ruth A. Allen, single, in consideration of the sum of One Dollar and other valuable consideration, the receipt of which is hereby acknowledged, does hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the right to enter upon the land described and the perpetual right to construct, reconstruct, clean up, operate, maintain, cover over and repair a storm sewer and a sanitary sewer, upon, under and across the land described as follow s: A strip of land 22 feet wide, 5 feet lying northerly of and 17 feet lying southerly of a line described as follows: Beginning at a point 175. 13 feet north and 45. 32 feet west of the intersection of the Chicago and Northwestern Railroad and the south line of the Northwest Quarter of Section 34, Township 84 North, Range 24 West of the 5th p. m. , thence North 620 341 East 155 feet, thence a strip of land 50 feet wide 20 feet lying northerly of and 30 feet lying southerly of a line described as North 790 351 East 287 feet, thence North 760 231 East 215 feet, thence North 350 271 East 194 feet, thence North 270 511 East 77. 7 feet to a point 572. 9 feet North and 1123 feet West of the Southeast corner of the Southwest Quarter of the Northeast Quarter of said Section 34. There is also hereby granted a temporary right of encroachment over and across adjacent land on each side of the above described line for On- struction purposes. The foregoing rights are granted upon the express condition that the City of Ames, Iowa will assume liability for all damages to the above describe property caused by the city's failure to use due care in its exercise of the rights granted.
