Hunziker and Margaret H. Hunziker, husband and wife; and Donald M. Furman and Ruth W. Furman, husband and wife, of Ames, Story County, Iowa, in conideration of the sum of One Dollar, receipt of which is hereby acknowledged, do hereby grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use its electric lines, consisting of poles, wire] overhead or underground cables, fixtures, anchors and other similar equipment, or any part hereof, for the sole purpose of conveying electric current for power and lighting purposes, together with the right to use jointly with the grantees, any pole placed pursuant to the provisions thereof, together with the right to trim any trees to allow for clearance of at least four feet, where necessary to secure adequate clearance for the safe operation of the electric lines, upon, underground, or adjacent to that certain piece of real estate described as: The West 5 feet of Lots 1, 2, 3, 4, 5, 6 and 7; the East 5 feet of Lots 10, 11, 12 and 13; the South 5 feet of Lot 3; the South 3.75 feet of Lots 9 and 13; and the North 3.75 feet of Lots 8 and 12, all within Tenth Addition, Melrose Park Subdivision, Ames, Iowa. We further grant to the City of Ames, Iowa, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use its sanitary sewer facilities upon, underground or adjacent to the following described real estatei The South 10 feet of Lot 4; ih e +h 5 t + Let 19 and 614e p3ei-4n-5—feet ef-met 95 all within Tenth Addition, Melrose Park Subdivision, Ames, Iowa. We further hereby grant the City of Ames, Iowa, its successors and assigns the perpetual right to construct, reconstruct, maintain and use its storm sewer facilities upon, underground or: adjacent to real estate described as follows: HEGLAND&NEWBROUGH AMES, IOWA WOK........Z'TAGE.. E..01 -2- The South 5 feet of Lot 10; the North 5 feet of Lot 9 and A 15 foot easement, the West line thereof described as commencing 15 feet West of the Northeast corner of Lot 9, and running South to a point 25 feet West of the Southeast corner of Lot 89 all within Tenth Addition, Melrose Park Subdivision, Ames, Iowa. The foregoing right is grantDd upon the express condition that the City of Ames will assume liability for all damage to the hereinbefore described real estate caused by the said City's failure to use due care in its exercise of the granted rights.
