OCT 211946 David Dancer, Secretary 4yCity Clerk,Amen,Iowa State Board of Education, BUILDING Dear Mr. Dancer: The Executive Council, at a meeting held this date, approved the following Right-of-Nay and Easement for Storm Sewer: The Iowa State Board of Education for and in consideration of the conditions as herein contained, does hereby grant to the City of Ames, Iowa, the right to construct, reconstruct, operate, maintain and repair a storm sewer in the location as described herein and shown on the plat attached hereto and made a part hereof, upon and across the property of the State of Iowa known as Iowa State College, located in the Southeast one-quarter (S*) of the Southwest one-quarter (SWJ) of Section 4, Township 83 North, Range 24 Nest of the 5th P.M. so long as the said City operates and maintains said sewer after its installation. The foregoing right is granted upon the following express conditions, to-wit: (1) That, the storm sewer shall be constructed in the following described location: Beginning at a point which is nine (9) feet south and fourteen (14) feet west of the intersection of the center line of Welch Avenue with the center line of Lincoln Way in Ames, Iowa, and running thence north thirty-three (33) degrees fifty-one (51) minutes west approximately one hundred and thirty (130) feet to an outlet into College Creek. (2) That, the City of Ames, Iowa will assume liability for all damage to the property of the State of Iowa known as Iowa State College, caused by said city's failure to use due care in its exercise of the granted right. (3) That, the City of Ames, Iowa will upon the completion of the construction of the storm sewer mentioned herein replace and restore the property of Iowa State College in its original conditions as nearly as possible.
